Purpose and acceptance<\/b><\/h2>\n<p class=\"p4\">These terms and conditions govern the purchase of products via the futonllit.com online shop. Upon completing an order, the customer confirms that they have read and accepted them. A record of this acceptance will be kept alongside the order.<\/p>\n<p class=\"p4\">These conditions are supplemented by the<a href=\"https:\/\/futonllit.com\/en\/legal-notice\/\"> <span class=\"s1\">Legal Notice<\/span><\/a> and with the<a href=\"https:\/\/futonllit.com\/en\/privacy-policy\/\"> <span class=\"s1\">Privacy Policy<\/span><\/a>. In the event of any discrepancy regarding the contract, these terms and conditions shall prevail.<\/p>\n<p class=\"p1\">We reserve the right to amend these terms. The version applicable to each order is the one published at the time the order is placed.<\/p>\n<h2 class=\"p2\"><b>3. Who can buy<\/b><\/h2>\n<p class=\"p1\">To make a purchase, you must be of legal age, have the legal capacity to enter into a contract and hold a customer account with futonllit.com. The customer is responsible for the accuracy of the details they provide; we accept no liability for delivery delays or errors resulting from incorrect or incomplete details.<\/p>\n<h2 class=\"p2\"><b>4. Products<\/b><\/h2>\n<p class=\"p4\">The photographs, measurements, colours and descriptions are provided as accurately as possible. As these are solid wood furniture items and handcrafted futons, there may be variations in colour, grain, knots and finish, which are characteristic of natural materials. These variations do not constitute a defect nor do they give rise to a claim for non-conformity.<\/p>\n<p class=\"p1\">The availability shown on the website is for guidance only. If a product is unavailable after the order has been confirmed, we will notify you immediately and you may choose to wait until it is back in stock, replace it with another item, or cancel the order for a full refund.<\/p>\n<h2 class=\"p2\"><b>5. Prices<\/b><\/h2>\n<p class=\"p4\">Prices are quoted in euros and include the applicable VAT. <b>Shipping costs are not included<\/b>, which are calculated and displayed separately before the order is confirmed.<\/p>\n<p class=\"p1\">We reserve the right to amend prices at any time; the applicable price is the one in force at the time the order is placed. In the event of an obvious typographical error in a price, we will notify the customer as soon as possible, and the customer may either confirm the order at the correct price or cancel it free of charge.<\/p>\n<h2 class=\"p2\"><b>6. Purchasing process<\/b><\/h2>\n<ol class=\"ol1\">\n<li class=\"li3\">The customer selects the products and adds them to their basket.<\/li>\n<li class=\"li3\">Log in to your account or create one.<\/li>\n<li class=\"li3\">Please enter your delivery and billing addresses, including your tax registration number, which is required for issuing the invoice.<\/li>\n<li class=\"li3\">Choose your delivery method and view the total amount, including delivery charges.<\/li>\n<li class=\"li3\">Accept these terms and conditions and make the payment.<\/li>\n<li class=\"li4\">You will receive an order confirmation by email within a maximum of twenty-four hours, in accordance with Article 28 of Law 34\/2002.<\/li>\n<\/ol>\n<p class=\"p4\">The contract is deemed to have been concluded upon dispatch of this confirmation. Payment methods<\/b><\/h2>\n<p class=\"p4\"><b>Payment via the website.<\/b> The only payment method available in the online shop is the <b>bank card<\/b>. We accept Visa, Mastercard and American Express debit and credit cards.<\/p>\n<p class=\"p4\">Payment is processed via the secure payment gateway at <b>Redsys<\/b>, with Banco Bilbao Vizcaya Argentaria, S.A. acting as the acquiring bank. The card details are entered directly into the payment gateway\u2019s system and are not stored on our systems at any time. The transaction may require the customer to undergo enhanced authentication with their bank.<\/p>\n<p class=\"p4\"><b>Other payment methods.<\/b> Outside the website\u2019s checkout process, and subject to prior agreement with us, it is possible to pay for an order via <b>bank transfer or Bizum<\/b>. In such cases, the order is placed by email or telephone and is processed once payment has been confirmed. Customers must contact us at info@futonllit.com or on (+34) 932 922 149; we will provide a delivery quote which will include, where applicable, customs clearance charges, and <b>The order will not be considered confirmed until the customer has expressly accepted this amount<\/b>.<\/p>\n<p class=\"p4\"><b>Taxes and duties.<\/b> All prices shown on the website include the applicable Spanish VAT.<\/p>\n<p class=\"p4\">For shipments to the Canary Islands, Ceuta and Melilla, as well as to countries outside the European Union, including Andorra, the tax treatment is determined on a case-by-case basis depending on the destination and the circumstances of the order. In such cases, we will contact the customer before confirming the order to agree on the applicable terms, and <b>The order will not be considered confirmed until the customer has expressly accepted the final amount<\/b>.<\/p>\n<p class=\"p4\">These shipments may also be subject to import taxes, customs duties and customs clearance charges in the destination country. These charges are payable by the customer; they are not included in the price shown on the website and are beyond our control.<\/p>\n<p class=\"p4\"><b>Delivery time.<\/b> Orders for products in stock are dispatched on the next working day following confirmation of payment. Delivery times vary depending on the destination town and are usually between <b>3 and 7 working days<\/b> from the expedition.<\/p>\n<p class=\"p4\">For bespoke or made-to-order products, the lead time is agreed with the customer when the quotation is accepted, depending on the materials and the workshop\u2019s current workload.<\/p>\n<p class=\"p4\">Delivery times are estimates and are calculated in working days from the date of payment confirmation. If, for any reason, we are unable to meet the stated delivery time, we will inform the customer as soon as possible, and they may choose either to wait until the new delivery date or to cancel the order and receive a full refund.<\/p>\n<p class=\"p4\">We accept no liability for delays attributable to the carrier, force majeure or the customer\u2019s absence from the address provided at the time of delivery.<\/p>\n<p class=\"p4\">Upon receipt of the goods, the customer must check the condition of the packaging and note any apparent damage on the delivery note. Visible damage must be reported to info@futonllit.com within <b>twenty-four hours<\/b> following delivery, accompanied by photographs.<\/p>\n<p class=\"p4\"><b>Delivery method.<\/b> In the city of Barcelona, delivery is made to the customer\u2019s address and <b>includes installation<\/b> of the product, at no extra cost.<\/p>\n<p class=\"p4\">For all other destinations, delivery is carried out <b>at street level<\/b>, excluding delivery to the customer\u2019s address and assembly. The customer must ensure that someone is present to take delivery of the goods at the agreed address and time slot.<\/p>\n<p class=\"p4\"><b>Filmed outside Barcelona.<\/b> We offer an installation service in other towns. As the cost depends on the distance and the nature of the order, a quote is provided on a case-by-case basis. Customers can request this service by emailing info@futonllit.com or by calling (+34) 932 922 149; the service will not be arranged until the customer has expressly accepted the quoted price.<\/p>\n<p class=\"p1\"><b>In-store collection.<\/b> Certain products can be collected free of charge from our shop at Rambla del Prat, 2, Barcelona. Availability depends on the product and its dimensions. Where this option is available, we will inform the customer of the timeframe within which the order will be ready for collection.<\/p>\n<h2 class=\"p2\"><b>9. Bespoke furniture<\/b><\/h2>\n<p class=\"p4\">Certain products are manufactured in accordance with the dimensions, materials or finishes specified by the customer. In such cases:<\/p>\n<ul class=\"ul1\">\n<li class=\"li3\">The order is confirmed on the basis of a quotation expressly accepted by the customer, which sets out the agreed specifications.<\/li>\n<li class=\"li3\">It is the customer\u2019s responsibility to check that the measurements provided are correct before accepting the quote.<\/li>\n<li class=\"li4\"><b>These products are excluded from the right of withdrawal<\/b>, in accordance with Article 103(c) of the consolidated text of the General Law for the Protection of Consumers and Users, as these are goods manufactured to the consumer\u2019s specifications or clearly personalised. This is expressly stated prior to acceptance of the quotation.<\/li>\n<\/ul>\n<p class=\"p1\">This exclusion does not affect the statutory guarantee for lack of conformity, which also applies to these products.<\/p>\n<h2 class=\"p2\"><b>10. Right of withdrawal<\/b><\/h2>\n<p class=\"p4\">A customer acting as a consumer is entitled to <b>fourteen calendar days<\/b> from the date of receipt of the product, you may withdraw from the contract without having to give a reason and without incurring any penalty.<\/p>\n<p class=\"p4\"><b>How to exercise it.<\/b> Simply notify us at info@futonllit.com or in writing at Rambla del Prat, 2 \u2014 08012 Barcelona, before the deadline expires. You may use the withdrawal form provided at the end of these terms and conditions, although this is not compulsory.<\/p>\n<p class=\"p4\"><b>Product returns.<\/b> The customer must return the product within a maximum of fourteen calendar days of notifying us of their decision, in its original packaging where possible and in a condition that allows it to be resold. The customer is liable for any reduction in value resulting from handling other than that necessary to check the nature, characteristics and functioning of the product.<\/p>\n<p class=\"p4\"><b>Cost of the return.<\/b> Direct return costs are payable by the customer. As these are bulky items which, by their very nature, cannot normally be returned by post, the collection cost is equivalent to the delivery charge for the relevant area: <b>\u20ac90 on the Spanish mainland, \u20ac180 in the Balearic Islands and \u20ac250 in the rest of the European Union<\/b>. In the Canary Islands, Andorra and destinations with a personalised budget, the cost will correspond to that of the transport originally booked.<\/p>\n<p class=\"p4\">Once we have been notified of the cancellation, we will arrange for the collection as soon as possible and confirm the exact amount with the customer before processing it. If the customer prefers, they may organise the return themselves using the carrier of their choice.<\/p>\n<p class=\"p4\"><b>Refund.<\/b> We will refund all amounts paid, including standard delivery charges, within a maximum of fourteen calendar days from the date we are notified of the cancellation, using the same payment method used for the purchase. We may withhold the refund until we have received the product or until the customer provides proof of its return.<\/p>\n<p class=\"p4\">If the customer has chosen a more expensive delivery option than the standard one, we are not obliged to refund the difference.<\/p>\n<p class=\"p1\"><b>Exceptions.<\/b> No right of withdrawal applies to products that are made to measure or clearly personalised, in accordance with clause 9.<\/p>\n<h2 class=\"p2\"><b>11. Statutory warranty<\/b><\/h2>\n<p class=\"p4\">All our products are covered by the statutory guarantee of conformity under <b>three years since delivery<\/b>, in accordance with Article 120 of the consolidated text of the General Law on the Protection of Consumers and Users.<\/p>\n<p class=\"p4\">During the first two years, it is presumed that the defect already existed at the time of delivery, unless there is evidence to the contrary. From the third year onwards, it is up to the customer to prove this.<\/p>\n<p class=\"p4\">In the event of a lack of conformity, the customer may choose between repair or replacement of the product, or, alternatively, a price reduction or termination of the contract, in accordance with the terms laid down by law. We shall bear the costs arising from the rectification.<\/p>\n<p class=\"p4\">The right to bring a claim expires five years after the non-conformity becomes apparent.<\/p>\n<p class=\"p1\">Normal wear and tear, damage caused by misuse, incorrect assembly by the customer, damp, prolonged exposure to the sun or a lack of proper maintenance of the solid wood are excluded from the warranty.<\/p>\n<h2 class=\"p2\"><b>12. Complaints and dispute resolution<\/b><\/h2>\n<p class=\"p4\">Any complaints may be addressed to <b>info@futonllit.com<\/b> or by telephone on (+34) 932 922 149. We undertake to reply as soon as possible.<\/p>\n<p class=\"p4\">We have <b>official forms for complaints, claims and reports<\/b> available to customers at our shop at Rambla del Prat, 2, Barcelona.<\/p>\n<p class=\"p1\">Customers may also contact the relevant consumer protection bodies, in particular the Catalan Consumer Agency of the Government of Catalonia and the Municipal Consumer Information Offices.<\/p>\n<h2 class=\"p2\"><b>13.
